Should Portland amend Council Organization and Procedure Code related to the Council Agenda, Council Rules, and Council Committees (amend Code Chapter 3.02)?

The City of Portland ordains.Section 1. The Council finds:On November 8, 2022, voters approved Portland Measure 26-228 (the “Measure”). The Measure significantly amended Portland’s City Charter. The Measure generally established a mayor-council form of government with a City Administrator, created four new geographic districts with three councilors represented in each district, and called for a new system of electing City officials using Ranked Choice Voting. On November 20, 2024, the City Commission approved Ordinance 191973, “Amend Code to align with the amended City Charter approved by voters in Portland Measure 26-228 (amend Code Titles 2, 4, 9, 22, 23 and 30, replace Code Titles 3 and 17, and repeal Code Title 8)”, the final change to Title 3 made under the Commission form of government, which established operating rules for the new City Council and which took effect on January 1, 2025. City Code regarding the City Council’s operations were made under the previous Commission form of government and must be updated to conform to the changes adopted by the voters in Measure 26-228, including reflecting the new responsibilities of the City Council, the executive Mayor, and the City Administrator. City Council operations must reflect the principles of the Charter changes adopted by the voters in Measure 26-228, including separation and balance of powers, public input and accessibility, efficiency, a Council committee structure, and a City Council focused on policy, budget, and oversight.NOW, THEREFORE, the Council directs:Amend City Code Chapter 3.02 as shown in Exhibit A.The City Auditor is authorized to correct citations in City Code in accordance with this and other Charter Reform amendments approved by Council and may consult with Auditor’s legal counsel or the City Attorney’s office as necessary.The Council President will ensure a proposal to replace or extend Chapter 3.02 is placed on the Council Agenda by October 31, 2025.Section 2. The Council declares that an emergency exists because a delay in the City’s implementation of these rules would cause meetings in the intervening 30 days to have different procedures, creating confusion for the public and City staff; therefore, this Ordinance shall be in full force and effect from and after its passage by the Council.
