Mr. Weinstein was previously selected among that pool as an alternate. Reappointing Mr. Weinstein as an alternate will not fundamentally change the impact of the CBPA's membership and structure.

WHEREAS, in November 2020 Portland voters approved a ballot measure, with 81.58% in favor, creating a new police accountability and oversight system, adding it to the Charter as Chapter 2-10; andWHEREAS, in October 2024 the Portland City Commission adopted Ordinance 191892, which amended City Code, creating Title 35, "Community Police Oversight Board"; this defined processes for appointments and reappointments to the Community Board for Police Accountability (CBPA); andWHEREAS, on June 18, 2025, City Council accepted a report (Council Item 2025-246) appointing 21 members and six alternate members to the CBPA. Pursuant to this action, Robert Weinstein was appointed as an Alternate member of the CBPA; andWHEREAS, on February 11, 2026, City Council accepted a report for the removal of certain CBPA members and alternate members following background and eligibility checks (Council Item 2026-047). In this action, Council removed Mr. Weinstein from his position as alternate member for cause pursuant to Portland City Code 35.20.10(G)(1) for non-completion of the administrative requirements for membership. Specifically, Mr. Weinstein declined to sign the CBPA's then-current "Non-Disclosure and Confidentiality Agreement" (the "Former NDA"); andWHEREAS, on March 9, 2026, Mr. Weinstein filed a lawsuit against the City, Robert Weinstein v. City of Portland (Mult. Cnty. Cir. Ct. No. 26CV11595) (the "Litigation"), in which Mr. Weinstein alleged that the City's requirement that CBPA members execute the Former NDA violated Article I, section 8, of the Oregon Constitution; andWHEREAS, the City Administration engaged in negotiations with Mr. Weinstein to resolve the lawsuit and avoid the expense and inconvenience of litigation; andWHEREAS, the City Administration has reached a negotiated settlement with Mr. Weinstein that includes utilization of an updated non-disclosure agreement, public posting of certain CBPA trainings, and recommendation by the City Administration to City Council for Mr. Weinstein's reappointment to his prior position as alternate member of the CBPA. The negotiated settlement outlining these terms and others is set forth in Exhibit A ("Settlement Agreement"); andWHEREAS, the Settlement Agreement is only effective upon City Council reappointing Mr. Weinstein to his prior position.NOW, THEREFORE, BE IT RESOLVED that Council appoints Robert Weinstein to a term as alternate member of the Community Board for Police Accountability with a term ending February 10, 2029.Membership ChangesAppointed as AlternateTerm Start DateTerm End DatePrevious MemberRobert WeinsteinOctober 21, 2026February 10, 2029 Full MembershipNameMember/AlternateTerm Start DateTerm End DateMurtaza BatlaMemberFebruary 11, 2026February 10, 2029Justice BrooksMemberFebruary 11, 2026February 10, 2029Ash JimenezMemberFebruary 11, 2026February 10, 2029Tida Lane-HoweMemberFebruary 11, 2026February 10, 2029Tim O'DonnellMemberFebruary 11, 2026February 10, 2029Timothy PittsMemberFebruary 11, 2026February 10, 2029Dina RossMemberFebruary 11, 2026February 10, 2029Kyle AshbyMemberFebruary 11, 2026February 10, 2028Corinne FrechetteMemberFebruary 11, 2026February 10, 2028Schuyler (Hugh) HalseyMemberFebruary 11, 2026February 10, 2028Gillian HerreraMemberFebruary 11, 2026February 10, 2028Shelley MaddoxMemberFebruary 11, 2026February 10, 2028Jesse NeilsenMemberFebruary 11, 2026February 10, 2028Benedikt SpringerMemberFebruary 11, 2026February 10, 2028Madeline CarrollMemberFebruary 11, 2026February 10, 2027Sara CitrenbaumMemberFebruary 11, 2026February 10, 2027Trish GarnerMember February 11, 2026 February 10, 2027Terrence HayesMemberFebruary 11, 2026February 10, 2027Pete La RausMemberFebruary 11, 2026February 10, 2027Natisha PrattMemberFebruary 11, 2026February 10, 2027Erica (Atticus) SommerfeldMemberFebruary 11, 2026February 10, 2027Todd BatemanAlternateFebruary 11, 2026February 10, 2029Robert WeinsteinAlternateOctober 21, 2026February 10, 2029
